In this Clause, Event of Force Majeure  means an event beyond the control of humans,which prevents a party from complying with any of its obligations under thisContract, including but not limited to:

2) War, hostilities(whether war be declared or not), invasion, act of foreign enemies, mobilization,requisition, or embargo

3) Rebellion, revolution,insurrection, or military or usurped power, or civil war

4)  Contamination by radio-activity from anynuclear fuel, or from any nuclear waste from the combustion of nuclear fuel,radio-active toxic explosive, or other hazardous properties of any explosivenuclear assembly or nuclear component of such assembly

5) Riot, commotion,strikes, go slows, lock outs or disorder, unless solely restricted to employeesof the Supplier or of          hisSubcontractors

6) Acts or threats ofterrorism

Consequences of Force Majeure Event

If an Event of ForceMajeure results in a loss or damage to the Facility, then JMD APP shall rectifysuch loss or damage to the extent possible, PROVIDED that any Cost ofrectification is borne by the customer. COST BEING DEFINED AS HAVING NO PROFITCOMPONENT.

In such cases, we willproactively reach out to you. Please check your emails and SMS regularly forsuch updates.

Also, we will not beable to compensate for any mental agony caused due to delay in delivery. Thecustomer can cancel the order at any moment of time even if the delivery timeexceeds the expected delivery time. If it is a prepaid order, the customer willbe refunded back in the account as soon as the order is successfully cancelled.

These terms shall be governedby and constructed in accordance with the laws of India without reference toconflict of laws principles and disputes arising in relation here to shall besubject to the exclusive jurisdiction of the courts at Jodhpur .

UnauthorizedCharges on your card

If you see charges onyour credit/debit card for purchases made on cloud.jmdhost.com, but you never createdan account or signed up, please check with your family members or businesscolleagues authorized to make purchases on your behalf, to confirm that theyhaven\\\'t placed the order. If you\\\'re still unable to recognize the charge,please report the unauthorized purchase within 60 days of the transaction to enable cloud.jmdhost.com  to begin an investigation.

Cancellationof Fraudulent/Loss to business Orders

To provide a safe andsecure shopping experience, we regularly monitor transactions for fraudulentactivity. In the event of detecting any suspicious activity, cloud.jmdhost.comreserves the right to cancel all past, pending and future orders without anyliability. cloud.jmdhost.com  also reserves theright to refuse or cancel orders in scenarios like inaccuracies in pricing ofproduct on website. We may also require additional verifications or informationbefore accepting any order. We will contact you if all or any portion of yourorder is cancelled or if additional information is required to accept yourorder. If your order is cancelled after your card has been charged, the saidamount will be reversed to your Card Account. Any promotional voucher used forthe cancelled orders may not be refunded. 

Thecustomer may be considered fraudulent if any of the following scenarios aremet:

1.     Customer doesn\\\'t reply to the payment verification mail sent by cloud.jmdhost.com

2.     Customer fails to produce adequate documents during the payment detailsverification

3.     Misuse of another customer\\\'s phone/email

4.     Customer uses invalid email and phone no.

5.     Overuse of a voucher code

6.     Use of a special voucher not tagged to the email ID used.

Thecustomer may be considered loss to business if any of the following scenariosare met:

1.     Customer with a very high return rate

2.     Invalid/Incomplete address cases

3.     Repeated request for monetary compensation for petty issues
 

Account for thecustomers falling in fraudulent or loss to business category may be blocked.Any gift credits earned through loyalty or referral program will be forfeitedin such case.

Bulk Sms Delivery

Any product/service, except designing ordevelopment services, will be activated within 1 to 2 working days after thepayment is received. The confirmation of the same with the necessary details orcontrols, invoices and receipts shall be mailed to the registered email addressaccordingly.

For Web Hosting Accounts

All new web hosting accounts are covered by a 30 day money backguarantee. If you become dissatisfied with our services at any point within thefirst 30 days of holding an active account, we will issue a 100% refund of yourmoney unless otherwise specified at, or prior to, the time of purchase.

For Web Hosting Renewals

Your web hosting account will renew on a monthly or yearlybasis. Refunds for web hosting account renewals will be granted to customerswho request a cancellation of their service, in writing, no later than 5 daysbefore the renewal date. No exceptions will be made to this policy.

For Web Designing/Development

In case any client is not completely satisfied with our serviceswe can provide a refund within 30 days from the date of installation of theProject. The final refunds will be made after deducting the Service Tax and theHourly charges for the work completed by us.
